I have never hear of a weld failure on the offside of the axle, as far as I know all reported failures have been the nearside.

This tends to support the hypothesis that the problem was with the manner in which the NS weld was implemented, or possibly the weld positioning, rather than any fundamental flaw with the concept.

As you observe, one would not really expect the bolts to be the weak point.

Axle Failure
So can I ask forum members if there is anywhere I can find a record of how many of these vehicles have been recalled, how many axle failures there have been and how many accidents have resulted from those failures? I'm sure this is the information that the solicitor will be asking for. TIA, PWD

If you look at page 14 of this topic this may help with the number of vehicles that fall within the vin recal range.

Have you read this topic , especially ALL posts by Payney1000 , he has been pursuing the Legal route https://www.defender2.net/forum/topic55655...p;start=60

If you read from page 5 on you will see the significant progress he has made.

It may be worth reaching out to him via a PM. Noting in one post I think he mentioned two suspected deaths due to this in the EU.

Also If you look at page one of the same topic you will see that member noworries4x4 had the axle case split at the weld, inc pics.

I would take dated pics showing the brackets have not, and never have been fitted as evidence as they could say they fitted them and you have removed them. I've done all this, & so far apart from admitting that they only cleaned the vehicle, & not fitted the brackets, have not got back to me despite further emails & phone call.

Well, for obvious reasons, mine is still showing as not having been done. Apparently their part-time technician didn't/couldn't fit them. I'm sure my youngest grandson could do it as he's already repaired tractors!

I've a feeling that this is going round in ever-decreasing circles at my end!
I will give it until next week then take some serious action.

Well at last I have a reply from my local main dealer....

It's not good, in fact it's the last straw for me.
Apparently, the brackets cannot be fitted due to the fact that the vehicle has a replacement, non-standard chassis. Also it has been Poly-bushed. Neither Land Rover or the dealership have any further responsibility in regard to the N706 recall.

Thus they decline to do any work on the vehicle.
Where this leaves me is in an impossible position: The recall still shows outstanding at JLR & DVSA.
In the event of an accident the insurers would use this as a complete get-out. I cannot remove the recall from either of the databases, even if there is a work-around.

The only reason the 110 has a newly fitted Marsland chassis is because the original LR 'kit-Kat wrapper' chassis rotted through at 30,000 miles.
So, here I am , an OAP living totally 'out-in-the sticks', totally reliant on this vehicle (& trailer), as this is the only way that anything larger than a weekly shopping load can be got here!

All sensible & reasonably priced solutions welcome. For now the vehicle is grounded.
Surely I cannot be the only person on this forum with an N706 recall and a vehicle with a replacement chassis?

I've not asked that question, however, if I did, & in the unlikely event of them agreeing, - the one thing I can't do is clear the outstanding recall notices at JLR & DVSA.

However, I will give the dealer a chance to supply the brackets...

I suppose we shouldn't be surprised by JLRs attitude, another vehicle crossed off their list at no cost to themselves.

I suspect you've been washing it with a non dealer supplied shampoo as well.

I wonder if you were actively looking for a new JLR product would they have treated you the same....Probably!

Having to put a new chassis on a 12 plate is shameful.

Why should a chassis change affect a bolted on axle?

Polybushes? maybe.... why not try and borrow a couple of front radius arms fitted with standard rubber bushes, fit them then take the vehicle back?

I was about to say the same thing, nothing to do with the chassis.

Also I really can’t see what difference having polybushes fitted makes as all they have to do on each side is remove two nuts, slide a bracket on, then refit and torque up the nuts. They don’t have to touch the bushes.

If they were rubber bushes, would they check they were LR or aftermarket ones , and if aftermarket refuse to do the work !

As long as the aftermarket parts are certified to be used on your vehicle they are ok, LR are not allowed to force you to buy parts from just them.

From a legal standpoint I don’t think they can refuse to do the work on the grounds they have stated.

Perhaps contacting another dealer and getting them to do it would be the solution.

None of those mods can affect the serviceability of the axle case weld, and it is preposterous to suggest that they do. I would certainly have a substantial argument with Land-Rover about this.

I suspect that the dealer has had a brush-off from JLR or is following an inane "policy", but I wouldn't stand for it myself. I'd be making a thorough nuisance of myself by now! Evil or Very Mad
