Not the case. If you read the link I provided above it clearly states that road vehicles (ie. those NOT exempted or SORN'd) MUST use road duty fuel. That implies regardless of use - on private land or public road. If it is not an exempted vehicle and is registered or classed as road vehicle it is not permitted to use red diesel at all. The use and location has no bearing - it is the class and registered status of the vehicle. So if you use red diesel on private land or off-road then get tested, you will be liable for prosecution regardless if you can prove that use/location or not.... Doesn't matter how you want to 'explain' it at the side of the road. |

Blimey - where were you? It's £1.25 around here Tell someone you love them today because life is short.
But shout it at them in German because life is also terrifying and confusing... |

It is quite depressing when you realise how much duty is put on fuel. From what I remember fuel prices (for the general public) back then was about €1.21 a litre but an agreement with the German government saw us not paying the duty (about 50c)..... Then again this was when the exchange rate was €1.50 to the £1
Currently stuck paying £1.40 here in West wales (the red diesel tank on the farm is tempting though, lol). Glyn |

Might be of relevance. It is a bit contradictory, if you're using a vehicle for agricultural purposes there is no limit to the distance, but if you've registered a 4x4 as an agricultural vehicle and it's being used for agricultural purposes there is a limit. |

Although this applies to N Ireland, the fact that its illegal to use on a non agricultural vehicle is a moot point, if it's used on private land, regardless of it's classification, the Police/HMRC can't do a thing. The legislation to stop only applies to a public road. For agricultural vehicles, there is a specific distance IIRC of 7 miles of its address of registration/land boundary. Outside this distance, the burden of proof falls on the owner to prove the vehicle is being used within its agricultural classification and not for private purposes where it would then fall foul of fuel duty and no insurance. Most agricultural vehicles are not insured for SD & P....

Was it just urban myth that in Ireland the authorities were checking tractors had RFL and any that didn't couldn't (when being used on the road) be classified as AGRI and therefore the operators were penalised for tax evasion??
Sounded a bit skewy to me but made sure I displayed a tax disc (in Scotland ) |

As stated in one of the replies only time you can us red is on private land/farm etc where the vehicle is not taxed for the road. If taxed do not legal to use red.
If you are a farmer it is possible to use red on highway if farm vehicle and it is only used to travel directly from one parcel of land to on other where highway has to be used. |

Hi,
I am always surprise of some discussions about the quality of diesel in UK. I am not a specialist but I do not find any difference in Belgium or in France with all the company's. But , about the red diesel, are you sure it is the same. We have a machine at work with Perkins engine , we did have some problems at one moment and they told us it was because we are using red diesel Regards, Philippe current : defender 110 sw 2.2 puma 2012 and 230.000km today and again my Range Rover VM2.5 engine from 1992 and 528.000km today. "More than 40 vehicles were stopped in Darley Dale as part of a campaign to clamp down on dangerous drivers. A Land Rover stopped for a routine check was found to be running on red diesel. Representatives from HM Revenue and Customs dispatched another team to the owner’s home address and seized more fuel from that location. Enquiries are continuing." We can actually buy different grades of Red depending on what machinery we're using. Modern machinery requires slightly more expensive fuel, though how much technical difference there is I don't know. Possibly all delivered out of the same tank. |
