Hi Ken This was my first post...
In the eyes of the law, this is correct as there is no legislation that changes 1989 Vehicle Law. DfT have made the exception for retro fit if fitted in accordance with their guidelines and for new cars there is EU type approval. So unfortunately my 'sweeping statement' was and is still correct. Tim has since stated that for JW Speaker lights in particular he has a similar exception from VOSA, and this goes further to say they don't need headlamp washers or self levelling. So with this formal exception in hand I'd be happy to fit the JW Speaker headlamps knowing they were legal. So from my point of view it's been a worthwhile exchange. Cheers Steve |

Quite a debate there.....Ultimately I am happy to re-announce my Defender passed it's MOT a few months ago as I am sure several other forum members have with LED headlights fitted. It's not as if it is one of the 'covert' fitments to fool the tester either, so thought then it wasn't an issue. If you go through life with your head in the sand....all people will see is an ar5e!!

Unfortunately passing an MOT means nothing for legality, as has been proven a number of times. As an example, you could fit tyres that extend past the wheel arches and pass an MOT as they are not tested. However, you'd fail a type approval test and its illegal to do this. MOT is just an annual roadworthy test, it's not a type approval road legal test.
Personally with headlamps I wouldn't fit any that weren't proven to be legal. It's all too easy to have an accident, caused by another driver, however they claim they were dazzled by your headlights. If they were deemed to be illegal, the police would be coming after you and worst case if there was a fatality you could facing manslaughter charges. All hypothetical of course, but still possible. Anyway, as Tim stated the JW Speaker headlamps have an exemption, so my example is irrelevant in this case. Cheers Steve |
