100% Agree with pom, get rid asap. It is simply not worth arguing/pleading they don't care about you. Put your energies into more important things.

Guys please re-read what I have posted. I cannot just tip it off and "get rid". If I do I am liable for IMMEDIATE repayment of any shortfall, and I have to get their permission to sell it even assuming i could find a buyer. And how do I get to work without a car? As I said, I don't see it really going all that far anyway, although there are a few potentials in the mix that I should have an answer to in the next 48 hours. Nor is it in my nature to just walk away when I am being shafted, I've had many a grovelling apology from big corporations in the past, and I think Landrover themselves may well take a keen interest in the case if only to avoid the negative PR. 2011 110 USW

if your struggling to make the payments I dont see you have much choice. Of course your allowed to sell your truck anytime, it's just hard to find a buyer if it's not hpi clear, it's pretty common to sell and pay off the outstanding finance all at the same time.the buyer just pays the finance company the balance directly. If you have to eat some negative equity this will be a lot less than what your currently paying now a month I would have thought, even if you bang it on a 0% card.

Then buy a very cheap couple hundred quid economical runaround to get to work while you get back on your feet financially.

It's a bitter pill to swallow but at least you won't have the worry of trying to make those big monthly payments.

I do sympathise with your situation - However to state that interest should be illegal is quite frankly absurd. Why would someone lend you the money which you were quite happy to borrow, unless they stood to gain from doing so? Sorry to hear that your business as not worked out, hat off to you for having a go.

Unfortunately I think you are in self denial of the situation,

1) You have defaulted on your side of the contract, very simple black and white, ok they could have been a little more understanding but at the end of the day this is the real world, no one holds your hand in the real world.

2) Difficult to sell the vehicle ?, the finance company now have you identified as a risk, they will only be to glad to let you sell the vehicle and recover their outstanding balance. Call them today and ask them for a settlement figure, it happens all the time. Only problem I can for see is the value of your Truck as oppose the settlement figure

3) You need the car to go to work ?, not if you can't afford it, ok if once you start your job and it is affordable, keep it, otherwise take Pom's advice and get a 500 quid run about until you get your finances sorted.

4) Letter to Land Rover ?, your short on funds, don't waste the price of the stamp.

Dan, your a member of the Defender community, take it on the chin, treat it as a life experince and move on. Richard

right at the begining of this post I stated call the FSA they are the only people who can really steer you in a direction.

For my sins Im FSA regulated (Not going in to why) just call them, a forum is not the right place to get this sorted .

You my not like the answer they give but you will know exactly where you stand (There is a Chance you will but we are in a seriously Censored position as a country, but they will be firm but extremly fair)

Dan, so sorry to hear its not worked out for you but I admire your courage in giving it a go and as with most things in life you will have learnt loads from the experience when you can finally look back on it.

Listen to Ken, FSA are the guys to speak to, it feels as if you are diverting your energies from the fundamental issue - getting rid of the debt - sort that out first then worry about the morals and unprofessional attitude of the finance company, or those that agree or disagree with you on here.

You should feel proud that you tried the venture and winding it up is part of that whole process, approach it as a business decision, the truck was a business asset, the business has ceased, the truck needs to go, don't muddy it with personal needs.

And I'm pretty sure you will have a great friend network who may well be able to lend you a little run around to get back up and on with the next big thing Thumbs Up

Good luck with getting this sorted. It is difficult but when dealing with business issues you have to be calm and dispassionate and keep it very seperate from your personal life . For your sanity wind it up and move forward. Get the FSA involved and trust them to give you the honest answer even if it is not the one you want.

Landrover customer services is a freepost address, won't cost me a thing to write them.Might cost FGA a fortune in lost business...

Let me make one thing clear, as I feel this thread has ventured way off track - the question here was not "oh no, I can't afford my car, how can I make these nasty people go away" it was asking what experiences other people have had with this firm, pointing out that they are unreasonable and inflexible in their attitude to their customers, and that they are doing Landrover no favours with this attitude. When I told the selling dealer how I had got on with they were shocked and confused as much as I was, as they had fully anticipated a compromise.
As I said, by next week this will all be over and done with IN MY FAVOUR.

Positive advice has been given by Ken and Shaun and is most welcome and valid, to be honest the rest of the thread could almost be considered poking fun at a difficult situation. Maybe a bit-of self-reflection is required in some quarters. Its almost come across as "if you can't afford it we don't want you here".
I shall leave this thread at this point now, I got the information I wanted and I am grateful for that.

Just as a parting comment, don't forget it could happen to you too, to any one of us, as none of knows what is arround the corner. 2011 110 USW

Hi,

Brilliant you got it sorted.

All I saw in the thread was people trying to give you some advice you asked for, some of it you probably didnt want to hear and some of it really useful for you.

I hope I never offended you by telling you to sell asap but I was just expressing my own opinion of what I would do. And yes your right it only takes a little problem in some cases to upset the balance in life.

Your a fighter from what I see and that can be a good thing Thumbs Up

I called FSA and they passed me to Trading Standards as motor finance does not come under the FSA remit. Anyway, long story short OFT think that FGA are in breech of contact by refusing to even discuss an amendment to the agreement, and have advised me to make an official complaint, mentioning the numerous phone calls, the fact they didn't properly respond to my letter etc.

In other news, I was just offered a full-time permanent job so that's another two-fingers up to the nay-sayers and the finance firms.
