Interesting, as I have a standard drop plate with an adjustable hitch attached to it...I wonder how that would fare?


I also have a Bradley jaw locking Alko hitch fitted and he didn't question this though the plate was visible on it. If it was purchased in the UK then it should be type approved and there should be a sticker on it some place to prove it showing weights etc.

But would this be on the adjustable part (sold to me by a trailer centre) or the drop plate, which I think does come with a label on from Landrover. Its a bit dark right now so I can't check.


As said earlier, your's is N1 so approved tow bar shouldn't be an issue. However re Dixon Bate type adjustable hitches, my 07 had a genuine parts tow bar with adjustable slider and whilst the main part of the tow bar has the approved plate the slider didn't so I don't see how yours could be an issue. John

I do not think they come under the scope of an Operators licence but come under towing laws.

They don't unless they are selling the digger. (I think)
It will apply to me, that much is clear, as I am paid to move cars. It would also apply to a farmer taking cattle to be sold, crops to be sold etc. It would not apply if he used, for example, a Landrover and trailer to carry his tools.

Small business are getting it from all sides at the moment. I did hear there is some sort of energy tax due to be introduced on business soon - as if there isn't enough to worry about...

Which frikin' genius thought of that one?

Have you got Federation of Small Business membership? May be worth contacting them?

Well it was one of those "when I can afford it" things...I'm going to get an answer from VOSA first. The impression I get is that this is being kept quiet so they can rake in a fortune in December, I can't see how anyone transporting any good can be exempt, so I bet the farming community will go nuts at this. Thats why I am telling everyone I can think of who needs to know.

To be honest if this does come in I cannot afford the money or time to get it all set up, my neighbours would have the right to object, it would be a ballache if we try to move house etc etc. The O licence (in my opinion) is for people operating fleets of HGVs, not a bloke with a Landrover and trailer, or a farmer taking a few sheep to the market. It could well skewer sales of 4x4s too, as now you may as well just go the whole hog and buy a lorry. I am also curious, would I be subject to car or HGV law on things like tyre tread depth? Totally hypothetical I know, but it still needs to be decided. Or would we have a situation where it is treated as a lorry when towing, but as a car when not? 2011 110 USW

"All drivers who passed a car test before 1 January 1997 retain their existing entitlement to tow trailers until their licence expires. This means they are generally entitled to drive a vehicle and trailer combination up to 8.25 tonnes MAM. They also have entitlement to drive a minibus with a trailer over 750kgs MAM."

There was no way I could see builders, gardnerers, pikeys etc paying 8 grand a year to tow. Just wouldn't happen.

If you passed your test post jan 97 then you have to take a test. No biggie.

POM... nothing like you for picking the bits out of a forum and blowing them out of all proportion... you don't pay £8,000 a year to run a O licenced vehicle but need to show you have access to £8,000 as back up to pay a major cost should it occur. Once you apply and recieve your O licence it cost nothing until renewal falls due in 5 years. As an HGV/LGV operator i think something has to be done as there are too many chancers shifting goods by agricultural and trailered vehicles. If the VOSA guys had thought of this 25 years ago less general haulage companies would have went to the wall. My sympathies go to the OP but if he cant do it profitably what chance has a haulage firm got... he sounds like he has been filling a loophole that is about to be closed? It is not a game, peoples lives are at risk. 2008 RS4 gone, 123d M Sport, and a Puma 90 XS..

POM, there is a BIG difference between an operators licence (restricted or otherwise) to having a towing licence or a B + E licence


The towing licence says the government/DVLA etc gives you the right to tow

On my licence I have B + E and 7.5 tonne driving rights

I do not have an operators licence restricted or otherwise issued by the traffic commissioners


I can hire a 7.5 tonne lorry and as long as I am not doing it for 'hire and reward' I can drive it all day long and completely ignore drivers hours

Put a single quickfist/oztent in the back and it comes business use and I need an operators licence (restricted or otherwise), conform to drivers law etc

So for occasional use of a HIRED 7.5 tonne lorry besides being of good standing etc I would need the following

a) a service/maintainence agreement in place! It is a hired 7.5 tonner
b) a place to park it overnight which meets local council and the commissioners approval. I don't need it overnight!
c) have to advertise in the press etc etc


IF 22 interpretation is right (which I hope he is wrong) and restricted operators licence is needed for business use to tow a trailer then it does becomes a 'biggie'

Autojumble at shows? Most of them would need restricted O licence

Traders at shows could need restricted O licence

etc etc

Small businesses? Shafted, yet again

where does it say in black and white an operators licence is needed to tow a 2-3 ton trailer ?

I spoke to VOSA again yesterday, they said that they do not know at the moment if that exemption will be kept of not. The light trailer exemption is going. What about farmers taking produce to market, I asked. Thats a good point... don't think the implications have been considered with this, is what they said.

All that matters is that IT IS exempt. They are never going to change that, like I said builders, gardeners, campers etc are never going to pay £8k. Fingers crossed the overpaid, overpensioned dimwit who is thinking all this cr@p up is part of the cuts. Can live in hope!

They could do a poll tax though and try it out on the jocks first to see how it pans out Mr. Green

ps why not get in touch with your MP and let him sort it out, as long as its not one of red ed's though as they were the ones who probably dreamed all this up.
