I parked my car for about 20 mins at the Warwick Welcome Break Services on the Northbound M40 yesterday. At around 12:45 whilst grabbing some lunch, a white flatbed van (Registration YP16 UGR) reversed and hit my car (Volvo XC70). According to a witness - he got out of the van, inspected the damage and then drove off. Minor damage (slight scuff and broken light lens). On looking at the web, a light unit is almost £300 new!!! I called 101 and they advised me to pop into a Police station. I did that, but the |Police then said they were not interested - wasted journey. So - what do I do now??? If I tell my insurance, will it affect my "no claims". I could try getting the owner of the van (I think I can pay £10 and find the owner)...may be difficult if it's leased? I have the contact details of a witness (the one who gave me the reg number of the van). What's the best course of action? I would rather not risk claiming on insurance. If it came to the crunch I would buy a 2nd hand light from a breaker (some on ebay for £120). However if I did the insurance route - I am sure it would be over £500, as the light is almost £300, and then labour etc at the garage (plus the pain if taking my car in etc) Defender "Puma" 2.4 110 County Utility (possibly the last of the 2.4's) |

Do you have protected no claims bonus? Given that you've got the registration and a witness, I'd let your insurer do the running around. It's either that or take a deep breath and get it repaired yourself.
I can't see any advantage in trying to track down the driver yourself, unless you're planning to thump him. I guess if he's an employee then you may have some luck with his employer, but your witness only really has value in a formal arena. I would contact you insurers discuss with them also see if you have any legal cover. Did the car park have CCTV coverage which you could provide to police?

Under the Road Traffic Act the carpark is classed as a road.
"Owing to the presence of a motor vehicle on a road wear by and accident occurs causing injury, damage to street furniture of damage to another vehicle the driver must report the accident to the owner of the property or police as soon as practicable." It is obvious that the driver failed to inform you either in person or by leaving a note, I doubt that he/she will inform the police. Offence 2. Fail to report a Road traffic accident. Offence 1 would be driving without Due care and attention. I hope that you have the details of your telephone conversation i.e. reference number and also the details of the person at the police station you attended should you report to your insurance company. I would suggest that you have been fobbed off when your attended the police station. Don't make old people mad. We don't like being old in the first place, so it doesn't take much to us off. MartinK, id just repair it yourself, by the time you have gone through all insurance etc, you could have it fixed your self.
light scuff you could get a decent body shop to sort that, light if your good with spanners your away. Plus it saves things going up too, If the insurance sorts it for you, you can bet it will be bloody expensive. The lad I know who repairs cars ( who has just welded the landy) he said that for a genuine light from the dealer which the body shop repairing it will use. your looking at 500 quid, Then there is the risk of how old your car is too, for them to write it off! If you have the registration number, you can get the registered keepers address, if you have reasonable cause: https://www.gov.uk/request-information-from-dvla
I did this when someone's child let their door catch in the wind and make a big dent in my door. I wouldn't have bothered but my dashcam recorded the driver getting out of the car inspecting the damage to my car then shrugging his shoulders and walking off. I wrote to the driver (a solicitor) suggesting the video evidence showed that he was aware of the incident. He immediately replied and offered to pay. Cost was such that he did it through his insurance in the end. If you are happy to get it done by local body shop and use second hand light it would be cheaper and easier and maybe van driver would cough up rather than add costs to their insurance. |

Not good...your call where to go from here. I'd go back to the Police and report it and expect that 'due process' is applied here...leave with a crime reference No. + the Name and No. of the 'reporting officer', as has been pointed out, a crime has been committed here. If you get the same response from the Police, initiate the Complaints Procedure...this may cause a change in their approach. Inform your Insurance Company, if you have one, your NCD may be protected in which case you are reasonably safe to proceed with a claim to recover your loss. Registration + Witness is a good level of information. I believe your Insurers have access to a Vehicle data base, that lists who currently insures the Vehicle that hit you, I think they then need to request Who is the insured 'named' driver. Flipping annoying....
In my book YOU should be no worse off than when you parked your car. So I would challenge this and get the Police to log it. The person who hit you obviously knew it would be pricey, newish car looks expensive let's just jump in and go. You should not have to buy a second hand light and fit it yourself and put up with the scuff... Fine if you did it yourself say reversing that's your call. I would insist to the police you need a crime number so report it, and do that today if you can. Isn't that classed as failing to stop after an accident and you have a witness? (possibly within 24 hours ? see here https://www.gov.uk/vehicle-insurance/if-youre-in-an-accident Could you also ask the security for a copy of the incident on DVD you know the time ets you will have a bang to rights copy to inform the insurance. Wow - thanks, Stacey - I'll see if I can get time to go to the Police again today - thing is it's an hour's round trip minimum (and I already went once today to be fobbed off) Defender "Puma" 2.4 110 County Utility (possibly the last of the 2.4's)
