Cheers for the nice comments, it took a long time to find it and it does look a lot newer than it is because of it's condition

Where to start, in brief the first of three buyers the day before collection [yesterday] did an hpi check on my truck and it failed coming back as a cat d write off in 2013, subsequently he lost interest and so did the remaining two when I informed them of his discovery.
The garage or employee of the garage whilst telling me all about the motor, knowing it from new, printing out reams of receipts for work done there forgot to mention it was a cat d when they purchased it! otherwise I'd have walked as well. I have tried to look into this and from what I can find out is a cat d is nothing to worry about!! yes it has a stigma attached but the damage wasn't deemed dangerous, structural or life threatening in anyway, merely an uneconomical repair so the insurance pay out and the buyer gets to keep the vehicle. Surprisingly the article said because of this "you don't have to inform any future purchaser of the vehicle" I have now owned this around a year and a half, been all over it, I wash the chassis down every week, I cannot see where any work was ever done? nothing stands out as being a newer bit? wear and tear equal on all sides, I don't get. Obviously I screwed up, thought I knew motors but i'm 55, we didn't have all that technology when I started, I thought an hpi check was to see if there was any outstanding finance and I was buying from a garage! Well it's still up for sale, I can't afford to take a hit on it so I'm guessing I cut windows in the back and fit seats in something that's already a bit small in there for my needs. What a week, now got to apologise to the guy who's car I was gonna buy Thanks for reading/showing interest Brian Do I now try and sell it on without telling the next guy |

My advice is if you really want to sell tleave it for sale it will sell eventually ,I think the market for used landrover s will settle down As prices are way to high at moment, I've been looking for a year for good 110 but everything is overpriced and doesn't sell. Eventually prices will fall and only best original landy's will attract a premium. One of my old 110 csw had been rolled and rebuilt , I still bought it , used it for travelling and sold it for reasonable money. Just be patient and don't ask to much Have fun be happy |

As third in line, I didn't think I would get to buy it and sadly I won't be buying it now either. To be fair I would have also done an HPI check, for a number of reasons 1) Theft 2) Insurance status and 3) Finance. With the large numbers going missing these days I would never buy a Defender now without an HPI check. I think that if you bought it from a garage they should have declared it a CAT D. Such a shame as it looks great, but I don't want to be the person who takes the hit on the value when it comes to reselling, sadly that should be the dealer who sold it to you or you. You seem like a genuinely nice guy so I'm sorry this has happened, but good luck with whatever you decide to do, I would keep it and make it work for you. cheers Jim |

The Catch-22 is that if Cat D was "nothing to worry about" they wouldn't have created a separate classification for cars that have been written off by the insurance companies; however, the catch is that if it is important enough to have the classification, why isn't it shown on the V5C! Unfortunately, as you are now finding out, Cat D cars are worth less than a similar car without the classification. Many buyers don't want the hassle and it was wrong that the seller didn't reveal this to you at time of purchase, especially as they are a "garage" (I assume it was sold by the business rather than an individual?). As you weren't aware that it was Cat D, I assume you haven't notified your insurance company. If this is the case, you need to revisit this. Insurance companies can refuse to pay out if you have not notified them that the vehicle has a Cat D rating. Is there any value in speaking with the garage you purchased it from? |

This is unfortunate as it looks a cracking vehicle.
If it is the law for garages to inform customers if a vehicle is cat D and they did not do so in your case, is it worth looking at your legal options to recoup your losses against the garage? |

Take it back to them and tell them they need to buy it back. You have three people who stood in line to buy it, so the price wasnt to bad.
It would be easier for them to buy it back and resell it than both of you paying out a fortune in legal costs and having Trading Standards involved. V8 90...WIP |

^^^ I agree with the above, talk to them nicely, explain that you've spoken to Trading Standards and they've advised they should have told you before purchase (which is definitely the case), be polite and don't lose your rag.
Tell them you'll give them 24 hours to think it over and you are only interested in a full refund or you'll be taking it further, they won't want their reputation dragging through the mud. It takes ages to build a business and minutes to ruin it. They'll probably offer you either the full sale price or sale price minus an extra owner and mileage. Best of luck |

Wow thanks for all the advice.
The car was advertised on ebay, a classified ad not auction. I was picked up at the train station and taken to the garage, the payment was made at the garage, the history was printed off on the garage computer, I sat in the garage waiting room while this was done. I got a hand written receipt from the chap I bought it off at the garage so I guess I bought it off him and cannot say whether he owns the garage or works for the garage. Bit that peeves me the most is they knew exactly what they were doing and obviously I didn't. I am writing to the garage, I have the address and I would lose it if I phoned, will have to wait and see what happens but I doubt much. Perhaps they do this regularly, buy write offs in an employees name sell them on to old git's that didn't know any better keeping things like cat d's quiet so they get full price. Who knows. Cat D is purely an insurance category. Could have been stolen recovered or just had paint damage that an excitable estimator valued over the cost of the vehicle.
You can get some great vehicles in cat D and pay a bit under the odds generally, I've done this several times now. Insurance cos generally don't care anymore. They've abolished the VIC check as everyone realised it was nonsense. |

One of the key things is the V5 - was the chap you bought it from listed on the V5, or, as in the case with most garages, did it list a previous owner and the person you bought it "from" was trading it? This will go a long way towards establishing whether the deal was a person to person, or busienss to person deal. Garages owners often use their network of contacts to buy cheap vehicles and sell them on using their garages credentials, but trying to stay away from trading laws they do it in the owner's personal name. The process is dubious. and the threat of dragging them through Trading Standards, the HMRC (because I bet he doesn't declare the profit - like a well known sponsor on here I suspect), and the courts might be enough to persuade him to act reasonably. I think a defender of this age the Cat D has less impact than for some other cars.
maybe £500? If you could obtain detail / photos of the damage that might reassure a buyer. David |
