Thanks POM, I have done some editing to the letter, and so has the wife, we are not asking for the moon, just the key, and I am no thinking that I can claim for the work I had done. I have spoken to the DVLA and they say all I have to do is fil in a V62 and the log book will be with me in 21 days. But that will cost £25 so I can add that to the bill too. Not sure if he has broken any laws by not sending the V5 off, but if anyone knows better please let me know. |

you mentioned some repairs, add them in if the fault existed when you bought the car. Put them in at full cost and then offer to pay some of it yourself. The judge loves this kind of stuff it shows YOUR being reasonable and the other person is not.
Also in my experience its worth getting 3 quotes for everything, even if the work has been already done the judge wants this. so be pre-armed it again shows you as being reasonable. Also dont forget to claim the for cost of bringing the claim itself, registered post costs, the application fee, also tick the box saying you claim interest as well. As paul_1978 says its not a bad process at all, just stand your ground, be reasonable, have the questions you want to ask written down and think up some of the answers to questions the other side is going to bring up so you are pre-armed. Take pictures of all those texts he sent you and include them in the court pack so the judge gets to see them, it all builds the picture of who is being the reasonable party. Pom ps if after he is served the key turns up the next day, dont close the case wait until he has paid the other stuff as well. |

Well hopefully it wont come to this, some of the chaps on the saab forum have been doing some digging, and none of his ebay accounts (found 4 of them) are registered for trade, all personal use. Definitely something dodgy going on. |

Sorry to sound a bit pessamistic, but I think you'll get nothing. The guy sounds like a loser and a muppet who will only give you grief.
I would hide the car, ignore all the other stuff and just ask for the key back. If that doesn't happen go with a big friend and ask politely for the key. Once you've got it, chalk the cost up to experience. There are so many dodgy part time not registered traders on ebay and I'm afraid to say "Caveat Emptor". However, best of luck - hope u get sorted. It's those people who give gen traders a bad name. |

Kennington Road (his stated eBay address ) is on the Nuffield Industrail estate, so judging by the number of cars he has for sale he probabbly is a trader of sorts. There is a fiat specialist garage listed on the same road so it's probably a sideline for him, I understand if sales are over a certain number then it's classed as trading, rather than the odd one outside your house.

6 per year He is a trader, he makes no secret of that. Just the fact he is dodgy! I am going to lock up the car until this is sorted. I can use the 90 now I have it back |

This letter will be sent today
Dear Sir It has now been 7 weeks since the purchase of the Saab 9-5 Registration number RV02RTX. I have a few issues I would like you to address. • During the delivery of the car you stated you would post me the spare key once you had returned to Poole after completing other business in London. - I have still not received the key. • During the purchase, you stated that the log book would be forwarded to me as soon as you had received it, - This too has not arrived. • 26th Jan I sent you a message informing you that the car had a problem, you refused to acknowledge this message. I have had to get the car repaired. It turns out that the issue seems to be a recurring problem, and had had to be re-diagnosed on several occasions now at cost to me. • The car has now developed more faults that I have had to have repaired at my own cost, including a defective alarm and defective air conditioning unit, plus the fact the original fault still remains. I have made attempts to contact you; I in return have received a barrage of threatening text messages, and rude voicemails. I would like to draw this issue to a close, so if you could please send me the spare key and the V5 via recorded delivery to the above address I would be most grateful. If the key is no longer available I will expect a replacement at your cost as the key was present at the time of test drive and you assured me that it was part of the sale. So could please send me the key and the v5, within seven days of the date above (deadline of 6th March 2012) If this is deadline cannot be met please inform me in writing as soon as possible, or you leave no choice but to take legal action for the costs I have incurred; for the V5 at £25, the running repairs so far at £150, this may become higher on the account of the fact the Air con and alarm are also defective, and a new coded key and transponder at £400 (subject to availability) I will also be forced to contact trading standards to inform them of the situation. I do not want to have to take this route or put any more time in to this situation than I have already, so please could you forward the key and the V5 to me as soon as possible. Yours Faithfully |

Nice letter. But for me the word "please" appears to many times. I would of written the same letter but told them what I wanted to happen and in a specific timeframe and left the pleasantries out of it. He has cost you time, effort and money. No need to be overly polite. Just firm.

Decent letter but I would remove the final paragraph, it's a bit "soft" really. I would just tag on to the end of the previous sentence "I look forward to receiving the key and V5 shortly."

The solicitor said to make it very softly softly, so as if it goes to court I have not been overly aggressive.
if it was letter number 3 then I could go balls out so to speak. Just spoken to consumer advice http://www.adviceguide.org.uk/index/your_w...t_a_dealer They have told me he is in breach of contract so if i do need to take it further they will back me up and assist with the legalities and any follow up letters, once the matter oges that far they will also inform trading standards. |

Sorry I may have missed it but out of interest did you get a receipt with the business name on it ?
If you ever want retribution all you need do is send a letter to the Inland Revenue suggesting he is selling cars & not declaring them, they are far nastier than the courts !! Just a 2020 P300 HSE |
