Can’t say for definite but MY accountant stated that only the H/T 90, H/T 110 or USW 110 were classified as “commercial” for tax purposes……
The later trucks are all ‘commercial’ for DVLA / road tax purpose |

In my opinion and I'm not a tax accountant the 2nd row of seats and windows make the USW not a commercial, though I am sure lots declare it as such and get away with it. Rob

That doesn’t make sense as a DCPU has 2nd row seats and windows. 2008 2.4 110 Utility Station Wagon XS.

There's a specific reference to Defender SW in the tax regs. Something about it being a lifestyle vehicle.

That’s not what my accountant mentioned……he specifically stated the 110 USW was HMRC qualifying |

You would think so. But l can't find a definite yes or no as to whether you can put a Defender Utility through a company as a commercial vehicle. Sure You could put it through anyway and take a chance on it. But it would be a very big bill if you got checked. According to the HMRC to be classed as "Commercial" the vehicle has to be "primarily constructed to carry goods" Even the HMRC website isn't clear on the Defender 2.2/2.4 Commercial. lt states that the Defender Station Wagon is a "car" but doesn't mention the Commercial Station Wagon. |

"primarily constructed to carry goods"
I have no need to know the answer to the posed question ..but surley if the vehicle V5 states its primarily a light goods vehicle that puts that point to bed..or does it??🤔😂 Click image to enlarge |

That would be far too easy. The Station Wagon has the same status. HMRC don't have the same opinion! |

thats purely a DVLA / Road Tax position - nothing to do with VAT or HMRC potential tax issues......... |

Can of worms, keeps accountants in a job
N1 or M1 ?? My 2/3 seat 110 HT is N1 but listed as 5 seater on the V5c HMRC will require you to declare percentage split for private use and business use when offsetting vehicle expenses against tax |
