Land Rover Trademarks
Following on from this post:

Jaguar Land Rover has lost an attempt to trademark the shape of its old Defender 4x4 after a long-running battle with tycoon Sir Jim Ratcliffe. ... However, last month, the Intellectual Property Office ruled that the Defender was not sufficiently distinctive from other 4x4s to justify the trademarks.

I thought I'd go looking for what they had actually filed, and found these:

Does not surprise me. On the 08 December 2014, Jaguar Land Rover Ltd published their application for a trademark on the term "Landy".

Trade mark number
EU013538475

And to an extent were successful, though how any anyone can own a word is beyond me, especially as the term Landy was thought up by the owners of Land Rovers rather than their manufacturer. For those who like Welsh Mountains and narrow boats have a look at my videos and photos at..

Looking at the dates of those application, a cynical person might suggest they were filed just to thwart Jim Ratcliffe, and not out of any particular genuine desire to protect the heritage of an iconic vehicle. 2007 110 TDCi Station Wagon XS

Much of it does seem like nonsense to me - OK for major model names but after that...

I'm sure they own 'truly appalling quality control'... Since 1973...S1, Air Portable's, Defender's, but only my Wolf TUL HS GS remains

A number of years ago I was talking to someone who at the time was a radio presenter, he has recently been taken to court for using his own surname by a large brewing company who had bought a smaller brewing North Yorkshire company. The larger company stated in court that they owner his surname as a Trade mark and therefore he would have to change it.

The Judge through the application out as " The court would have to rule that every person throughout the world with the surname would have to change it" Don't make old people mad.
We don't like being old in the first place,
so it doesn't take much to Censored us off.

So the original Times article stated that JLR had lost the cases to register the 6 shapes as trademarks.

I think they may have jumped the gun, as of the 6, the first 3 (all 2d) are now registered having been opposed, the 2nd 3 (all 3d) are still opposed, and the additional number have been withdrawn.

Some of the historical data does not show on the 1st 3, so it's now not possible to see who opposed them, or indeed how they then got to registered status. In my recollection these did show a rejected status in the past; however, there is now no record of that being the case!

On the 2nd 3, the opposition was posted by:

INEOS Industries Holdings Limited
38 Hans Crescent, London, SW1X 0LZ, United Kingdom

However, there is a Designs hearing decision which makes interesting reading:

https://www.gov.uk/government/publications...ion-o74918

https://www.defender2.net/gallery/albums/u...earing.pdf

Unbelievably, JLR's "representatives told me at the hearing that following two changes of ownership since 1999 the proprietor had been unable to find records establishing when the Land Rover Defender Heritage was publicly launched." Whistle

They lost the case and had to pay Ineos's costs.

The real killer HAS to be Ford's lawsuit with Ferrari over the latter's use of "F-150"

I guess they feared the public might confuse a Ferrari with a pick-up truck...
