The adventure 90 and 110 are the same price but the 90 gets the same power upgrade as the autobiography. (I think!) but the 110 does not.
Can't quite work out Land Rovers reasoning there as I would have thought that the bigger, heavier car would have needed the increased power more? |

Just because they have a clause in the contract doesn't mean that a judge would find in their favour should it go to court. If the judge finds the clause unreasonable he can disregard it so clause or not the dealer could not be sure that they would win.
Also not great publicity for them should the court case get reported, I imagine that there are a fair few D2 members reading this thread that would steer well clear of Land Rover Cardiff. |

Not the case, as I tried, clearly unsuccessfully, to make the point, the FM clause would be challengeable by any half competent lawyer, as a get out in the case of vehicle availability, as it is not a reasonable, or even valid FM clause...
I was not actually making an argument, simply pointing out the irrelevance of just quoting convenient extracts, when contracts are always taken in the round, whoever they may be with!... Not sure why it's the dealer's fault without getting a few more facts in? If the situation is exactly as reported above then the dealer is as much a victim of JLR as the OP. Talk of solicitors and judges setting aside contract terms seems a little far-fetched at this stage. If fundamentally JLR are going to make one less vehicle then someone has to miss out somewhere. I'd be speaking to the LR pr guy on here to see if the initial facts are true and then if they were asking if I could have one of the press vehicles. Would make a good news story for JLR - pulling the iron out of the fire.. |

This is yet another irrelevance, as I pointed out in my last... In any event, one can readily exchange JLR with Mr Dealer, or anyone else, the same principles will apply, simples... FM is a fairly restrictive, in legal terms, type of disastrous event, commonly referred to as 'Acts of God/Nature, or other major event wholly outside of the control of the parties. When included in any contract FM should, in any event, be clearly defined, such definition is generally done separately for clarity and not simply included within a convenience clause... Force Majeure: A typical list of force majeure events might include war, riots, fire, flood, hurricane, typhoon, earthquake, lightning, explosion, strikes, lockouts, slowdowns, prolonged shortage of energy supplies, and acts of state or governmental action prohibiting or impeding any party from performing its respective obligations under the contract.
