Not if packaging has been opened, I asked the question by email but they are choosing to ignore me Optimists say the glass is half full..

The seller says he will take the scangauge back, and issue a refund less 20% , as they will have to resell the unit in the opened packaging that doesnt sound right to me, I don't want the seller to be out of pocket either but surely they send it back to their supplier to re-package? I would have been happy with max 10% as that seems reasonable enough, but 20%? Optimists say the glass is half full..

Think of it. I ordered a jacket from Adidas. How could I try the jacket on if I left in the plastic package? Didn't fit me, got a refund asap. I didn't have to pay for the shipping costs for sending and returning the jacket.
That's simply the risk of selling stuff through the internet! |

Distance selling rules should apply and you should get a full refund. Look up distance selling rules and give them both barrels over the phone!!!

Opening the packaging doesn't mean you can't return the goods.
Page 20 here: http://www.oft.gov.uk/shared_oft/distance-...ed_PDF.pdf gives you the info. You can therefore return the item under the distance selling rules for a full refund |
