Definition of DUAL PURPOSE VEHICLE
Dual Purpose Vehicles A vehicle constructed or adapted for the carriage of both passengers and of goods or burden of any description, being a vehicle of which the unladen weight does not exceed 2040kg, and which either; (i) is so constructed or adapted that the driving power of the engine is, or by the appropriate use of the controls of the vehicle can be, transmitted to all the wheels of the vehicle; or (ii) satisfies the following conditions as to construction, namely (a) the vehicle must be permanently fitted with a rigid roof, with or without a sliding panel; (b) the area of the vehicle to the rear of the driver's seat must: (i) be permanently fitted with at least one row of transverse seats (fixed or folding) for two passengers and those seats must be properly sprung or cushioned and provided with upholstered back rests, attached either to the seats or to a side or the floor of the vehicle; and (ii) be lit on each side and at the rear by a window or windows of glass or other transparent material having an area or aggregate area of not less that 1850 square centimetres on each side and not less than 770 square centimetres at the rear; and (c) the distance between the rearmost part of the steering wheel and the back-rests of the row of transverse seats satisfying the requirements specified in head (i) of sub paragraph (b) (or, if there is more than one such row of seats, the distance between the rearmost part of the steering wheel and the back-rests of the rearmost such row) must, when the seats are ready for use, be not less than one-third of the distance between the rearmost part of the steering wheel and the rearmost part of the floor of the vehicle. Even though I have alpine and rear windows, and two inward facing fold down seats behind the driver I presume this rules out my 90 hard top from being a DPV? I presume a 90 station wagon with forward facing seats may be a DPV dependant upon the various measurements mentioned above? No, read it again more carefully. Your vehicle must be less than 2040kg unladen and meet EITHER condition 1 OR condition 2.
Since all 90s (as far as I know) are <2040kg UW and full-time 4wd all 90s are DPVs. |

For SPEED LIMITS, it is open to interpretation by the courts (will have to find some cases).
"Section 86 (1) and Schedule 6 Road Traffic Regulation Act 1984 Passenger vehicle, dual purpose vehicle, motor caravan (none of which exceed 3050kg unladen or 8 passenger seats) car derived van not exceeding 2000kg max laden weight or 8 passenger seats. Normal car speed limits." So that's the disco's and all defenders excluded as too heavy UNLESS you have rear windows when weight doesn't matter. next. "Passenger vehicle, dual purpose vehicle, motor caravan, car derived van exceeding 3050kg unladen or 8 passenger seats. Van speed limits apply." So this doesn't apply as all disco's and defenders are now NOT heavy enough! To muddy the waters more, defenders are not on the approved list of HMRC list of 'official' car derived vans despite them being cleary sold as such and VAT being able to be reclaimed. And finally a quote from the DFT Q. Are there any exemptions from these lower speed limits for vans? A. There is one (small) group of vans which have the same speed limits are cars by virtue of the definitions in Schedule 6 of the Road Traffic Regulation Act of 1984. These are vans that are both derived from a car chassis and also have a maximum laden weight of no more than 2 tonnes. This means that the weight of the vehicle and the payload it is designed to be able to carry when added together do not exceed 2 tonnes. The van design must be a derivative of a car body, it is not sufficient that it looks similar to a particular car. That reads to me that the DFT consider all landrover commericals to be vans as far as speed limits are concerned, the courts being useless would no doubt take their side. Perhaps someone could go get a ticket and take it to court! or Just make sure you have rear windows then its all fine! Pom |

The statement about the 2000kg gvw weight limit applies ONLY to car-derived vans and not to the other vehicle types. It serves to distinguish CDVs under 2T GVW ("car" limits) from CDVs over 2T (reduced limits) and has no relevance in any other respect.
Rear windows are irrelevant as far as speed limits are concerned. |

I've read all the way through this thread and am still confused ...
I have a 2008 USW 110 that is down as a CSW on the log book and I pay the higher rate of car tax, I want to tow a box trailer with a GVW of 2600 kg to shows with goods in (please dont delete this Martin, i'm not advertising) that I own that I will be selling - Do I need a tacho ???? Regards Matt |

Yes you will need to fit a tacho.You will NOT need an O-license. As luck would have it I am trying to arrange to have mine removed so I can sell it... |
