Now I am getting very confused here and will apologise up front if this turns into an abridged version of War and Peace.

Please note I had a telephone conversation before Christmas with Ian and I said I would resolve the issue however it might take some time due to the holiday season


This evening Peter received an email which I was cc into.

Now I in general terms think things like this issue should be dealt with in private and pms/emails should be private but since what I have as a personal conviction has been breached I will quote that email and I am sure Peter will understand whiy I am doing this.

This email was timed out at 18.55 on Friday 10th February 2017

My proposal of £100 covers my out of pocket costs cutting the notch, purchasing section of stainless to fabricate wing strengtheners/cutting and bending the steel and fitting them

Repainting the cross member and the rear wheel arch eyebrows would cost more than this which I believe I am entitled to claim for as this is a separate issue to me cutting out a small notch to accommodate my mud flaps (which I have done a great job of)

Now Ian is NOT a customer of Nakatanenga. What happens between 4x4 Nakatanenga and 4x4overlander is OUR business and nobody elses.

Now before any action by the Mediation Service can be undertaken there must be certain forms filed, defence submitted etc etc. I am NOT a lawyer, have never been in this situation before and have just skimmed read certain things. To date we have received no forms etc.

This is the second time that Ian has requested photographs. There are some in the public domain already so why is Ian asking for more?

I have ALREADY offered a FULL refund which is £425 PLUS said we will arrange COLLECTION. YES I have put a time limit on this offer!

Would Nakatanenga REUSE them? They are no longer suitable for sale as they have had UNAUTHORISED modifications done to them. As far as I am concerned they are scrap metal and NO we will not be sending them back to Nakatanenga

Am surprised Ian's daily rate of £420/day is not mentioned plus all the other items in various emails.

However on 10th February 2017 he claims

This really is all just pityful.
From what I have seen, I think someone on here did not prepare his road for success in court very well. Always weigh your written words before you put them on paper I would say.
And since there is a threat made of going to court, no need that the potential future defendant sends any more of the now still requested info by the potential future claimant. The potential defendant should now think of acting in the interest of his defense.
I only can say this, if someone would try to go to court here with this kind of preparation after having first blown hot, cold, then hot again, he would stand no chance and most likely get convicted to pay a fine for wasting taxpayers money on top of it.
Hope there is still time to accept that mistakes and wrong judgments were made, and possibly find a middle of the road out of court still now. Thumbs Up

followed this with interest and wont pass judgement on this but will comment on an experience I had

I purchased terrafirma corner bumpers they did not fit, (there is a thread on here about it), they hit the bodywork near the rear arch eye brows, also you couldn't fit the mud flaps with them, (sounds familiar),

I contacted the supplier and asked for a refund, refund agreed, I posted them and got my money back (just lost the postage) which made me a bit grumpy hence my thread on here at the time.

there is an issue with some pumas and corner bumpers in that the cross member is not straight and hence not 90 degrees to the body sides, most corner bumpers are made at 90 degrees (I'm assuming earlier defenders have straight cross members)

the terrafirma ones were badly made one was 90 degrees one was more like 82 degrees making the issue worse

I then purchased some unbranded corner bumpers off ebay that were better made and were both 90 degrees, I made spacers for between them and the cross member to make them square to the sides and hence not hit the body side, these too would not fit with mud flaps but not wanting to cut them I decided to cut the slot in the mud flap brackets instead reasoning that the mud flap brackets are cheap (relative to the bumper corners) and rust out quick anyway

will add photos when its light DEFENDER 90 TDCI XS,

Not really going to get involved further in your discussion and thanks for your reply to what's I said, even though I understood maybe 50% of it. I'd have thought that being an Engineer as you've stated you'd be capable of empathising somewhat with the complexity of designing items for vehicles with such awful build tolerances as Defenders - I know I certainly do. I work as a test engineer and often seen the complexity of aftermarket component fitment firsthand.

Christmas period finished on the 2nd of Jan for most, you waited 5 days until you modified and assumed no response was an invitation to do so. I stand by that being impatient.

'Further defect' the defect is that they didn't fit, in two places. Offer the component up to be fitted, see if doesn't fit, send it back. You fitted the item, modified, drove around for a few days until it damaged you're vehicle.

I'll leave it here and I hope you rectify your issue. Fortunately it looks like your issue hasn't affected anyone's opinion of 4x4 overlander and Nak!

P.S. Don't really understand your last sentence, think you're implying that you wish that I suffer the same issues you do or something? Kind of really showing your character here, childish comments have the potential of ruining your argument, whether you're right or wrong.

Also they were scratched on the leading edge when they arrived and you still fitted them!?!?!!?

Just rereread and had to comment on Brendan's revelation that you fitted on the 28th December not the 7th January. So now you're lying too. This whole thing is a joke and you're turning yourself into a laughing stock. Good luck in court, I know they appreciate lying.

Whoops one date wrong, i did cut and fit them on the 28th but e-mailed on the 7th chasing replies ( that bit I got right)

On the 23rd Dec 4x4 Overlanders reply I quote

Is that not tantamount to agreeing with me to cut the notch?

Here is the whole e-mail trail up to the 20th, I have not posted the most recent ones yet as I am now considering pursuing this through other avenues

"yes, we were not aware of it as well until today. We are working on a new metal fitting to use the original mud flaps. It will take a couple of weeks because of the holidays."

I note it is now over 9 weeks since the error was noted and still not modified brackets

All the way from the 23rd Dec to the 13th Jan 2017 I had no replies

I will not let this rest as I have stated 2 faults
1 - did not allow for mud flaps
2 - returns rub against the eyebrows

I do like reading the comments they really have assisted me in getting my full report in order, much appreciated. Smile

Are the spacer you propose 8mm thick which will sit on top of the 6mm spacers?
If so not really happy with this. Space on top of a spacer!
It is all a bit of a bodge

To eliminate placing a spacer on top of a spacer
- LHS spacer should 13mm (8mm you propose and the thickness of the existing which I assume is 6mm?)
- RHS would require two different spacers 6mm to sit on top of the swing away wheel carrier and 13mm to sit on the chassis member
Again I go back to I have to recut the notch 8mm wider to accommodate the mudflaps

Is there a reinforcing bracket that can be made to restrain the wing to stop it distorting into the bumper

Failing that the bumper needs to be made with a shorter return

Peter – Happy New Year, can you confirm that you have had my previously e-mail and pictures

Brendan was lovely talking to you earlier, As discussed and as per my e-mails below regarding my concerns that the rear wheel arch will rub against the leading edge of the bumper – it does
As soon as I go above 50mph you can hear the panel resonating against the bumper, I done 75 miles today and it was well annoying.
I have temporarily put sticky back velcro (the fluffy side) to act as a cushion as the paint is already getting damaged

The only way I can see to resolve this without having to take out off the bumpers and cut them shorter is to make a bracket that will utilise the lower arch rivet point and take this bracket back to the rear chassis member picking up the bolts that hold the rear seat anchor points to try and hold the rear panel firmly away from the bumper

Please see attached picture indicating where I have put the sticky back Velcro to try and stop the resonating/rubbing

Hi Brendan, sorry to bounce e-mails just trying to come up with options as I’m like a child in a sweet shop

5mm stainless awfully hard to cut if you don’t want to damage the paint.
The slot will have to be 50mm long and min 15mm wide to accommodate the mud flap and bracket 
Options
Cut Nak corners
- I have a plasma cutter which will wreck the paint
- Could try and angle grinder but will have to keep the metal cool
- Hacksaw will not touch such thick stainless plate, would take a week of Sundays
- The driver side mud flap rubber may have to be trimmed back ever so slightly to the top face whilst the passenger side mud flap rubber would not as it is shaped for the exhaust outlet
Cut mud flap brackets
- 50mm notch required as per the pictures I sent, the new stainless mud flap brackets have a reinforcing brace which should compensate for the notch – maybe
- The driver side mud flap rubber may have to be trimmed back ever so slightly to the top face whilst the passenger side mud flap rubber would not as it is shaped for the exhaust outlet
Or mixture of both
- Put a 25mm long notch in the corner 20 mm wide and take 25mm off the corner of the mud flap bracket.
- Using a 20mm mm drill bit to this will only leave 5mm to cut with a hacksaw which would be doable (1 Sunday lol)
I think this would be the best option and this is what I will probably do – see pictures attached

Seeing that 4x4 Overlander replies on here and not to my e-mails and I have just read your post and I assume you are not going to supply the info I have requested (please note it has been requested twice regarding the length of the return.)?
I assume from your post you are not considering my offer?
A no reply here as well as no reply to my my e-mail you posted I assume we will be taking things further.
I am therefor proposing to approach small claims court and will notify you early next week

Brendan I applaud your patience in this matter, (and no I am not part of the Brendan fan club) I just call things as I see them.

I am no litigation expert but I feel once a product has been altered by a customer to fit I would think the ownness is on them and the supplier could refuse to accept a return because its saleability is now reduced.

And while I understand that the purchaser is miffed as being supplied a product which he considers is not fit for purpose, I would have thought the sensible thing to do would have been to return the said item for a refund or at the very least wait until permission is given to self-engineer a solution.

4x4 Outlander in my opinion has gone out of their way to rectify the matter even to the point of an absorbed loss of over £400.00 and I am sure because of the alterations they do not have to.

I also think that a court would find the whole thing ludicrous and I feel that a small claims court would find the case for compensation unproved owing to the nature of the supplier’s responses and the purchaser’s actions.

Take the refund if it is still on the table and draw a line under this otherwise you will either be throwing good money after bad or worse end up going round and round in circles. For those who like Welsh Mountains and narrow boats have a look at my videos and photos at..

I don't think you will have a chance in court as you just said it was your 1/4 panel that would need securing to stop it resonating on the new bumper corners and causing damage so that's a fault with your vehicle and not the part provided. As above, if the offer of a refund is still available you should take it and run before you end up paying for court costs too. Does the losing party have to pay for the others legal bills? Ray

Iktank, what are you actually hoping to achieve with this thread?

If it is to advise us you had a problem with this product, you have now done so.

You've already rejected a full refund, so it can't be an attempt to get that.

If it is an attempt to sully the reputation of Overlander 4x4 and/or Nakatanenga, it seems to be failing since it is eliciting more comments supportive of them than you.

If it is an attempt to make you appear a bitter and grumpy person with unrealistic expectations and poor judgement, then it has worked rather well. I doubt, however, that that is quite what you had in mind.

Whatever the intention, may I respectfully suggest that the time has come to continue your negotiations with Brendan in private?
