England 1997 Defender 110 300 Tdi CSW Epsom Green
110 Utility- Self employed VAT registered, Car tax and VAT!!
Hi all,

Can anyone give me definative answers. Confused My local dealer has 2 nice 110 utilities in with about 40k on clock, both 2007 models - just what I am looking for. Am I right in thinking that :

1) I can claim the VAT back (my ltd company is VAT registered).
2) Even if bought on finance the VAT is reclaimable in one go.
3) It is classed as a commercial and therefore the benefit in kind to me will be just £600 p.a. as a cmpany car.
4) Is the vehicle - 2007 reg - taxed as a car c.£400 p.a. or a van c. £160?

I really want one but the only way I can afford one is through the company. Also need one as have 3 kids and car seats in the back of the 300tdi are not the easiest fit!

Anything else I should know about a 2007 Defender - gearbxf? flywheel? clutch? Land Rover approved used warranty?

I am not sure what you mean by utility?

I have a Defender 110 County Hard Top.

3 doors/2 seats/no windows in the sides

I do claim VAT back when I purchase these new. I have owned 9 and always claim VAT back. Also road fund licence is cheap. under £200?

I know some farmers have bought these, claimed VAT back then fitted windows in the back. VAT person visits, notices windows in back of Land Rover & disallows the original VAT claim.

Someone will no doubt be along shortly and provise a link to the correct legislation on the HMRC web site.

Just looked at my road tax.

£200 last time I renewed in August/September 2010.

Reading your post again I realise the vehicle you are looking at is not a Hard Top. I say this because you talk about having 3 kids. My Hard Top only has 2 seats so not suitable for any more than 2 people.

Ref any other things you should know about Defenders. You will probably have read my posts ref body cappings. Land Rover stopped galvanising them in 1996????? and since then have had endless problems with them rusting. The only solution is to have the vehicle rebuilt properly and have the body cappings galvanised. I had a quote for having this done to one of my Td5's and it was about £2K. Bought a new Defender & 2 years later here we are again.

There is no way I would but a Defender unless it has had its body cappings replaced with properly hot dipped galvanised ones properly fitted with gaskets etc to keep the dissimilar metals apart.

That is extortionate Mad £1 a KG to galv + labour to lift roof and sides off complete, drill rivets and put new ones back on. A days work at most Rolling Eyes

It took me 2 hours to unbolt a SW hard top, knock the rivet heads off and throw all the bits in a pile ready for galvanising. If you have to buy the cappings it is £300 apparently Ouch! but even then £1700 on top for galv and labour.............. Shocked Perhaps they resprayed over the rivets Neutral

Are you talking about a utility station wagon? If so, I believe this is classified as a light goods vehicle. The Double Cab is also classified as lgv, Station Wagons either 90 or 100 are are not.

As said previously, if you are looking at a 110 SW with an intention to add seats and windows then you are on potential sticky ground.

Definitive answer on VAT try the VAT helpline.

Believe it or not they are helpful

1) Yes
2) Don't know, ask VAT helpline
3) Check with your accountant and remember it is a 'pool' car Whistle
4) Utes are on about £200 rft

Remember if towing for business use , you will need a tacho fitted say another up to £1500

Im pretty sure that a 110 utility back then was not classed as a commercial, AndrewS had the same would be worth dropping him a pm Thumbs Up Only later ones are commercials early ones are converted cars.

sonic is correct on this, I was in the process of buying the same from a dealer who assured me it was a commercial, put deposit agreed price etc. When it came to insure it the V5 said it was a car. So unless you see the V5 then all bets off. All new ones are ok though.

I run a 110 Utility N1 class through the company books and did some research at the time of purchasing;

1. VAT can be claimed if the Defender is registered as a commercial vehicle. Check with the stealer, I think early Puma utilities were not classed as commercial. Tax disc will help, if it is £400 rfl then it's not a commercial. If you claim the VAT back on a non commercial class vehicle and the tax man finds out you will have to pay it back.
2. Depends on the the type of the finance. If you take out a business loan then no problem, leases are more complicated as you can claim the VAT on the finance. The lease adviser hopefully can explain.
3. For N1 rated pool car then I think it is £500 on your tax code, otherwise you pay a flat van rate and petrol allowance. I think it is £3000 and £500. If the defender is classed a private vehicle be prepared to pay ££££'s on tax benifit if its on the books!
4. Check with the dealer.

why do you want to be taxed on it, you only use it for business, if your home address is the same as your ltd company registered address, the the vehicle is always going back to the office at the end of the day not home with you even though they are the same address, hence no personal use, and in the morning you are no driving to work but leaving the office as they are both the same address, joys of being limited, Thumbs Up Thumbs Up Thumbs Up Bow down Bow down Bow down

got to love the tax man , he makes the rules,
yes you can claim vat in one go if paying by finance providing you paid the vat in one go first, hence thats why most places do the vat as deposit.

must check its a commercial first though as it was registered a couple of years ago, just check logbook,
rfl should be £200

go and get it and enjoy, dont forget all those accessories you need Wink are also offset against your tax and you can claim the vat on those, because you need that winch if you get stuck as your work takes you to remote places Wink

I am in a very similar position.

I am registered on the flat rate scheme but I understand that for large purchases I can claim the VAT back as the FRS covers smaller day to day stuff. Has anyone done this?

Also, if I buy things for it after I buy it initially (maybe a winch, MT/R tyres, RAI, roof rack and possibly a roll cage) can these be added later and still put into the business as 'large purchases' and the vat claimed back in addition to the flat scheme stuff or do they need to be fitted when I buy the car?

Finally, not sure if your line of business matters but I am management consultancy and IT solution deployment specialising in health and finance.

My bean counter told me that flat rate scheme allways is worse than doing proper vat.
