BMW is now under attack as per the news here today. The same NGO that brought to light the VW scandal now is reporting to have tested here in Europe a BMW X3 equipped with the 20d engine, on the road, not in the lab, and has found that in reality it overshoots the European exhaust gas limits by 11 times...
BMW for now of course is playing innocent. Will be interesting to see how this story will keep building.
Who knows, maybe our Pumas in reality are not Euro 4 and Euro 5, but only............ Shocked

I think there are two different problems here.

One is the test protocol in lab not being accurate and very different from real life driving, and the other problem is the car makers cheating with the tests. So far and unless proven otherwise, only VW has been caught with the hand in the cookie jar! (doesn't mean they are the only one, most likely not...)

Anyhow, I think all this has been kown for long and some people have just taken this opporunity to kill the Diesel, starting with the US...

As for the Puma, well, I always beat the given MPG so I reckon my real life driving style is actually more economical/eco-friendly than the tests Rolling with laughter

The EGR is fitted to reduce the NOx emissions.

It would be illegal if the EGR was enabled or was programmed specifically to defeat the lab tests but would remain disabled otherwise in real driving conditions - That is not the case.

It is illegal (at least in some countries, I believe in most European countries) to remove or disable the EGR, or tamper with any of the anti-pollution systems fitted on the car (that obviously includes DPF removal or fitting a decat exhaust).

VW is sinking deeper into this. Switzerland have formally banned all sales of new VW/Audi/Skoda/Seat cars which are Euro5 and which have a 1.2TDI/1.6TDI/2.0TDI. Euro6 is ok. First country to do this, wonder if others will follow. You never actually own a Defender. You merely look after it for the next generation.

As the Volkswagen emissions scandal spreads to Europe, concerns have been raised as to whether other manufacturers may also have played dirty.

VW’s ‘defeat’ software, which puts the engine in a low-polutant mode purely in order to pass an emissions test, has been used to falsify results in the Europe as well as the USA, it emerged recently.

As UK regulators prepare to re-test vehicles by other manufacturers to ensure the cheating is not widespread, JLR has expressed confidence in its emission reduction technologies, declaring to LRO that ‘Jaguar Land Rover does not use any emissions 'defeat' devices or software.’ Rog... Mr. Green

VW was singled out as there was some clever software that detected when it was in "test" mode, and cut emissions output

All manufacturers will fail when measured in the real world compared to the test lab, but they were only ever asked to meet the emissions requirements in the lab. What VW did was defeat the lab test, which is why they should have the book thrown at them. My Disco 'best bits'
