Incorrect Parking charge notice
I got home yesterday, opened the post and was suprised to recieve a letter from 'CP Plus' claiming to be a CHARGE NOTICE. It claims I was parked at Watford Gap services from 12.33 to 19.09 6 Hrs and 36 mins !!!!
It is impossible as I was visiting site elsewhere! I did visit twice southbound and once northbound on the day in question.
It provided 2 photos, both showing a MOVING defender, looking identical to mine. It says I agreed to T&Cs when I parked, which I didn't and they have provided no evidence off (which there won't be !) I'm guessing the camera/computer has ignored/missed my departures,new arrivals ???

I appear to have 2 options, Ignore or contact them. I will not on principle alone pay there £50 charge, as I wasn't there!!

It's basically a scam trying to frighten people into paying out.

Thanks John I have done some reading, and agree most are a scam. If I had broken the rules fair play, I'd pay the fine, But I have not, I simply drove through the services, and there hardware is confused! I have a number of witnesses who can place me and the defender elsewhere, oh and a tracker, but could realy do without the hassel. They will not be getting a penny !I am just wondering the best coarse of approach, A friendly call on Monday, or a snotty letter stating the obvious, including my charges for correspondence. Time is money, why should the onus be on me ??? !

Without getting irate a mistake has obviously been made. The onus is on you as you stated you were actually there. It is simply the timings that are disputed. A simple polite explanation with relevant details will not cost you much time, or expense. Getting angry and rattling your sabre will not get you very far, they naturally deal with people with that type of stance all the time. If you go through life with your head in the sand....all people will see is an ar5e!!

The best approach would be by letter stating your case, make sure you keep copies of anything sent. You should also ask them to send you a picture of the moving vehicle clearly showing the registration and ask them to provide a picture of the driver to confirm their identity because you have witnesses and evidence to show your car was elsewhere at the time their ticket was issued. The onus is on them to provide the details of the driver and prove their loss as the contract exists between the driver and the parking company. 2014 110 2.2TDCi XS Station wagon

Emotion starting to subside Thumbs Up A letter stating facts should straighten things out. Its just another issue to resolve, occurring due to others incompetence. John as a 'Parking Charge' , I'm more interested in evidence showing it parked !

Whilst in principle I know what you are trying to say but what is irrefutable is the fact you were indeed there at the times stated, it's just what's in between you need to clarify with evidence if possible. 'Parking Eye' in effect (which it failed in this instance) relies on entrance and departure times whether you were parked or driving round in endless circles they are claiming you were there considerably longer than you were. A simple phonecall (or better still e-mail) should square this away hopefully if you can provide some form of evidence as stated.

Cheers Mal. According to a pm from a fellow forum user well versed in this I need to write, as they won't accept representation from mail or telephone !! It was a good post day yesterday as someone has also placed some materials on one of my trade accounts !!!!!

Since you were on site somewhere I would strongly suggest you get copies of the signing in book which often has registration numbers, copies of the minutes of the meeting, copies of the invoice for your time on site, copies off atm receipt for you withdrawing money elsewhere, download your vehicle tracker log etc.

Give them a polite timetable of your movements that day and inform them that you will not be paying their INVOICE as there is no legal contract between the two parties.


Tell them that the matter is now closed and if they wish to pursue the matter any further they should take out a small claims court action against you. Clearly state that if they wish any further written communication from you you will be invoicing them say £25 per letter.

IF they do proceed to the small claims court for non payment of their invoice, you will (a) have your defence prepared (b) can counterclaim for any subsequent letters you have to write,

Remember if they do go the route of small claims court you can have it moved to your local court.


Also keep an eye on your Experian rating in about a years time just in case they try to give you a black mark as a non payer Again you will have evidence that the invoice is not valid and can then get any black mark removed.

Unless they have hard evidence then don't pay......
My wife went through exactly the same at a retail park a few years ago sent off an legitimate appeal to the parking company Excell which they totally ignored. We still refused to pay this resulted in a series of threatening letters over period of time resulting in solicitors letter threatening everything under the sun, this was received a couple of days before Xmas..this really upset my wife wishing she had paid it. We checked the solicitor out and he wasn't registered...
In our case it was a scam they use intimidation to force you to pay.....I guess the more vulnerable would pay...
We still get the odd letter from debt recovery firms after about 5 years, in our experience they are absolute bar stewards...
The AA legal team helped check things out for us and gave some good advice...

You have to make representations via email or letter.
a simple email, pointing out my departure and re arrival was all it took. A simple process really !
