Was he DVLA or VOSA?
DVLA has no authority to interpret the law, and although they can express an opinion I would be cautious.
VOSA also technically has no authority to intrepret the law but do have the authority to enforce the law, and probably have a much better idea of what is and is not legal (only the courts can make absolute rulings of interpretation).
Ultimately now the insurance companies are probably the final arbiters, since if they won't insure it, you can't drive it. The fact that something may be legal does not place any obligation on them to accept your insurance.
In this case if the guy worked for DVLA and was an enthusiast, he may well have taken the trouble to find out through official channels. I am sure he is better placed to express an opinion that most people anyway.
